Fort Lauderdale officials are hoping to crack down on vacation rentals in an effort to prevent out-of-towners from disturbing the locals with new vacation rental rules. Homeowners offering their properties as vacation rentals could soon have to obey additional regulations if they want to continue operating in the city.
The state says cities are prohibited to ban short-term rentals, not allowed to limit frequency of property rental, and can’t require a minimum length of stay. But Fort Lauderdale officials are taking steps to regulate them.
The proposed law would cap the number of renters in any home, require a local contact for emergencies and allow the city to revoke the licenses of homes that become a nuisance because of repeat violations of city laws. Also under the proposed changes, there couldn’t be more than 10 people in a rental in a single-family neighborhood. The maximum could be less based on other requirements, such as a parking space for every three occupants.
The city of Fort Lauderdale has been stymied in its efforts to restrict vacation rentals because of a 2011 state law that allows short-term rentals of any duration, unless a city had restrictions on its books prior to the state law. Fort Lauderdale argued it did have restrictions, but lost that issue in court in 2012. Now officials are trying to do what they can to make the situation more manageable. Mayor Jack Seiler wants any changes to be in place before the heavy tourist season returns in November.
