There’s always a good amount of new construction in the Fort Lauderdale area and the surrounding cities of Broward County. New Construction in Broward County, are in different stages of construction. Some are in the reservation stage (definitions below) and some are at the contract stage. Links to each specific project are below. Reservation Stage – This stage means the project is not legally allowed to go to contract yet. They’re taking reservations only on the unit you want. At this stage the reservation can be canceled by either party anytime before actual contract. The developer probably has not detailed out all the rules and regulations, final maintenance fees and any financing if available. This would have to be defined and communicated with each buyer before going to contract. Once all the details are known and revealed to the buyer, then the buyer has the option of going to contract if they wish. If not, then the buyer’s deposit would be returned with no penalties. The developers are not allowed to keep any money at this stage. Always have an attorney review your agreements to make sure you know what your committing yourself to.
Contract Stage – At this stage, all the details should be known including – the rules and regulations, maintenance fees. The project should be fully approved by the city along with all the condo or homeowners documents and approved by the city and state. Once a contract is signed the buyer has a full 15 days to cancel the contract, allowing them to go over the rules and regulations, the condo docs, financials, etc….. This is only true for new construction. Once the 15 days have passed then the contract is not cancelable and the buyer’s deposit could possibly be kept in full depending on the contract. Most developers have their own contract and most are considered cash contracts meaning that you can get financing if you wish, but the contract is NOT contingent on financing.
